Data Release Terms and Conditions
We have a responsibility to those that provide us with data to ensure that they are used in a manner in accordance with their wishes. The Steering Group has therefore approved the following terms and conditions for the release of data, and we ask all clients to agree to these on the Information Request Form when they ask for data. These T&Cs were updated in September 2016:

- Data are supplied on condition that they are only for the use of the enquirer and their client (if commissioned) and only for the purpose specified at the time of the enquiry. Data must not be passed on to others or stored beyond the life of the project for which they were acquired.
- Documents or data supplied by the BRMC, or another LERC if it is a cross-border data search, must not be made public in any format (including uploading to the internet) without written permission from the BRMC. Data may be summarized for use in the planning process, but must not be included in full, un-interpreted form (see CIEEM website for guidance). Location and grid reference information for species identified by the BRMC as sensitive must not be disclosed.
- Data must be stored in a manner that prevents their use and distribution beyond those permitted by conditions 1 and 2 above.
- The enquirer agrees not to modify the factual content of the material supplied and not to copy directly any parts of the material that have been identified by the BRMC as not to be copied (e.g. Ordnance Survey based maps, where licensing restrictions apply, or material of a sensitive nature). This applies regardless of the medium of the supplied material, be it paper or electronic.
- Data used in any form of document must have their source acknowledged as indicated by the BRMC.
- All rights in the data are reserved. Ownership of data is not transferred by this agreement.
- The enquirer must indemnify the BRMC against any claims made against BRMC or any of its employees for any loss or damage arising from the supply of data to the enquirer pursuant to this agreement.
- Data held by the BRMC, although verified as far as may be possible, are not definitive.
- There may be data concerning items in the ecological environment that are as yet unknown to the BRMC and which were not recorded in the BRMC at the time of this enquiry and for which the BRMC cannot be held liable.
- Some data may be withheld because of their sensitive nature, the requirements of the Data Protection Act, and/or conditions imposed by their owner.

Where the search has been completed as a cross border data search, the enquirer accepts the Terms and Conditions of the other LERC.
- Bat searches provided as a Bats-only or add-on service are carried out on behalf of the Bedfordshire Bat Group. These services fall outside of current cross-boundary data search agreements with the Buckinghamshire and Milton Keynes Environmental Record Centre and the Northamptonshire Biodiversity Records Centre. The enquirer accepts that if they require bat data for any part of a cross-boundary search overlapping the Bedfordshire/Buckinghamshire & Milton Keynes or Bedfordshire/Northamptonshire county boundary, they will have to make a separate request to BRMC and an additional fee will be charged. Bats-only or add-on Bat searches for cross boundary data searches covering Cambridgeshire and Hertfordshire will be completed under our current cross-boundary data search agreements as each of these counties provide the same service on behalf of their respective Bat Groups.
